ATLANTA, GA – (June 13, 2012) – TrustPoint International, an Excelerate Discovery company, and one of the nation’s fastest growing e-discovery and managed review providers, today announced the acquisition of San Francisco-based Black Letter Discovery.

TrustPoint’s acquisition of Black Letter Discovery, one of the country’s premiere document review companies, also known as “BLD”, gives the company a strong presence and storied history in San Francisco and Silicon Valley, as well as 3 large-scale managed attorney review centers in Columbus, Cleveland and Cincinnati, Ohio. Mark Hawn, Chairman and CEO of TrustPoint commented, “We are pleased to welcome a company so well respected into our family. BLD’s deep client relationships and rich candidate pool come from the same commitment to quality and customer service that we embrace at TrustPoint. There are tremendous synergies between our two businesses, and we anticipate a smooth transition and integration across the country.”

Ki Hwang, CEO and General Counsel of BLD added, “TrustPoint is exactly the type of company we wanted to join forces with! Their expertise in technology, e-discovery and managed review will help us better service our clients, and their existing national presence will provide a stronger foundation for our business. We are also very excited about their integration of Technology Assisted Review and Predictive Coding into their e-discovery arsenal.”

BLD was founded in 2003 and has consistently been recognized as one of the most admired and well-respected document review firms by both law firms and corporate legal departments. The combined company will now have more than 90 employees nationwide and operate out of 13 offices across the US, with 10 dedicated review centers. Most recently, TrustPoint merged operations with its sister company, Excelerate Discovery, to provide a comprehensive, one-stop offering to its client base. The BLD acquisition continues their expansion and fast-paced growth into both established and flourishing markets.

TrustPoint International (www.trustpointintl.com), a leading provider of collection, e-discovery, consulting, and managed review services, and Excelerate Discovery (www.exceleratediscovery.com), one of the fastest growing staffing and managed review solutions providers, today announced they will merge and operate under the Trustpoint International name. The combined companies will consult and provide solutions for corporate legal departments and law firms through the entire litigation lifecycle, from legal hold notification through to final production, enabling clients of both companies to be more effective and efficient in the e-discovery process.

“By bundling the numerous discovery services, TrustPoint can not only help achieve major cost savings, but also provide our clients with customized solutions tailored to their specific needs,” Mark Hawn, CEO of TrustPoint stated. “We will provide our clients with one hand to shake throughout the entire e-discovery process. This complete technology and consulting support for all e-discovery tasks in the litigation lifecycle – managed by one organization – creates efficiencies in time and cost while mitigating risk.”

Christopher Jensen, Partner at Excelerate, added “TrustPoint’s approach is to provide clients with expert advice and feasible options at each decision point in the discovery process. Combining the two companies’ highly qualified teams, best-of-breed technologies, and innovative processes makes sense, as it provides a single service provider to our clients, with integrated services across the entire EDRM [Electronic Discovery Reference Model] model, reducing time and saving money by simplifying transitions and hand-offs from the collections, processing, review and production phases of discovery.”

Having a true end-to-end option also provides clients with a variety of alternative pricing models that offer transparency, predictability, and certainty – most notably a subscription based model and a per document model. By controlling the steps in the e-discovery process, TrustPoint is able to eliminate inefficiencies, thus reducing cost. These savings are then passed on to the client.

TrustPoint’s capabilities extend beyond litigation e-discovery to investigations, regulatory issues, compliance, and related legal matters. In addition, its’ Client Advisory Group, the specialized consulting arm comprised of experienced project managers and consultants throughout the country, consult on such areas as Litigation Hold, Identification and Preservation, Collection and Early Case Assessment, Processing, Hosting, Document Review, Technology Assisted Review, and Production.

Excelerate Discovery was founded in 2009 by Mark Hawn and Christopher Jensen. TrustPoint International was formed in 2010, under the leadership of Hawn, Rick Avers, and Todd Tabor. The combined company’s Board of Managers will consist of Hawn, Jensen, Avers, Ed Caufield and Marc Zamsky. TrustPoint has offices in Atlanta, Baltimore, Boston, Chicago, Houston, Los Angeles, New York, Philadelphia, and Washington, D.C., and has Fortune 500 companies and Am Law 100 law firms as clients.

At this time all lines of communication including e-mail addresses and phone numbers will remain the same. If any changes occur at a later time, TrustPoint will be in contact with its clients about the new numbers and/or e-mail addresses. Rollout of the combined brand will take place over time; until then, clients will continue to see the Excelerate name and logo. Clients will still be able to go to both websites to find out about our offerings and services.

Full-spectrum eDiscovery consulting company TrustPoint International today announced that it has partnered with OrcaTec to provide its global clients with access to the predictive coding tool that was approved by the judge in the recent Global Aerospace case in Virginia.

“TrustPoint’s differentiation from other eDiscovery companies is our end-to-end consultative approach combined with a focus on our transparent, efficient, highly defensible process,” said Mark Hawn, CEO of TrustPoint. “We like to be ahead of the curve, so we had created an internal initiative to determine which product best fit into our process and satisfied our clients’ needs before our clients had even begun to ask about predictive coding.”

Hawn continued, “We tested a number of different products before deciding on the OrcaTec Document Decisioning Suite. We had made our choice before Judge Chamblin released his decision, but it is reassuring to know that a court is opting for the same technology.”

Dr. Herbert L. Roitblat, Ph.D., OrcaTec’s CTO and Chief Scientist, said he was pleased that TrustPoint and OrcaTec were partnering, too. “TrustPoint is certainly one of the fastest-growing consultative legal services companies in the market today. They are experts on what clients want, so their interest in OrcaPredict and the other tools in the Document Decisioning Suite is wonderful for OrcaTec.”

What made OrcaPredict stand out for Hawn from other predictive coding offerings was twofold: The first being its pricing model. “Our clients like cost certainty,” said Hawn. “OrcaTec is one of the few technology companies that can offer them that predictability. So working together will make it simple to continue with the fixed fee arrangements our clients require.”

The other thing Hawn liked about the software was that it was unique in not requiring a seed set of documents before starting the predictive coding. “OrcaPredict randomly, but transparently, chooses documents for the attorney to mark as responsive or not,” Hawn said. “So you don’t have to do a lot of preparation before you start coding. People spend a lot of time doing keyword searches before the predictive coding begins, but they sometimes pick the wrong words. Because you dive right in with OrcaTec, the first-pass review goes much faster and the accuracy is simply much greater. But OrcaTec has all the transparency and defensibility our clients want as well. That combination is a home run for us.”

OrcaPredict is just one of the tools in the OrcaTec Document Decisioning Suite, an all-in-one set of eDiscovery technologies that includes concept search, visual clustering, social network sonar and other advanced analytics, as well as email threading, redaction and review capabilities.

“Although we partnered initially for the predictive coding, we are looking forward to being able to offer all the other tools in the Suite to our clients as well,” said Hawn.

“We are delighted to have a partner like TrustPoint,” said Roitblat. “These are incredibly experienced eDiscovery experts who have worked all over the world with cases of all sizes. They will truly add value to OrcaTec, just as we hope to add value to them.”

In 1995, The European Union passed privacy legislation called the Data Protection Directive which places comprehensive requirements on businesses that collect, process and transfer personal data from the European Union to the United States. In consultation with the European Commission, the U.S. Department of Commerce developed a “safe harbor” framework which was approved by the EU in 2000. This Safe Harbor certification assures European organizations that the certificate holder provides an adequate level of protection required by this agreement.

“By ensuring that TrustPoint International meets European Data Privacy standards, the Safe Harbor Certification will enable TrustPoint to collect and process data in the European Union as part of our E-Discovery service offerings,” said Todd Tabor, Vice President of Operations at TrustPoint. Christopher Jensen, Partner ar TrustPoint, stated, “Due to the increase in litigation with overseas components, we felt it a neccessity that TrustPoint retain this certification for our current and expanding international client base.”

About TrustPoint International: TrustPoint International was formed by industry veterans from some of the most recognized e-discovery and staffing companies to deliver a unique approach to clients’ electronic data. It has become a recognized leader handling electronic data with a combination of experienced project management and technicians coupled with advanced software.

“TrustPoint is by far the most exhilarating company with which I’ve been involved,” said Mark Hawn, Chairman and Founder of the company. “The legal technology services and solutions market, particularly for ediscovery and managed review, is simultaneously enjoying tremendous growth and exciting change. We’ve positioned TrustPoint International to bring a new level of client-customized solutions to ultimately help streamline processes, create greater control and, in the end, save money,” added Hawn.

Hawn has also announced that colleague, Rick Avers, an industry expert himself, will assume the role of TrustPoint’s President. “Its great to be working with Mark again,” said Avers. “Mark’s approach to client solutions has always embraced innovative thinking and cutting edge technology in a culture of unyielding service. I’m honored to be part of this team and lead TrustPoint’s charge to become one of the most respected e-discovery and legal support services companies in the world,” added Avers.

Hawn founded Legal Copies International in 1998, which rose to $100 million in sales out of 26 national offices when it was acquired. It was named as one of Inc. Magazine’s fastest growing companies in 1994, 1995 and 1996. Hawn later went on to start DocuForce, which he merged into OnSite when he acquired that business. Hawn left OnSite after building it to $70 million in sales and its ultimate purchase by a venture capital group. Avers has always been a leading sales and client service executive with several well-known ediscovery and litigation support companies, with many AmLaw200 and Fortune 500 clients.
